Under Turkish Personal Data Protection Law No. 6698 ("KVKK"), personal data of visitors and users of the openyachtbid.com and openyachtrental.com platforms is processed by Bella International Yacht Brokerage Turizm Ticaret Limited Şirketi ("Company") acting as data controller, within the scope described below.

2. Personal Data We Process

Identity data (name, surname), contact data (email, phone), account data (user type, password hash), transaction data (bids placed, charter enquiries, listing records), enquiry and message content, and transaction-security records (IP address, session and log records).

3. Purposes of Processing

Managing membership and account processes; conducting auction, sale and charter transactions and connecting the parties; delivering bid and enquiry notifications by email; ensuring platform security and preventing misuse; fulfilling legal obligations.

4. Collection Method and Legal Basis

Personal data is collected electronically through registration, listing, bid and enquiry forms and through use of the platform. Processing relies on the legal bases in Art. 5/2 KVKK: establishment and performance of a contract, compliance with legal obligations, legitimate interest, and explicit consent where required.

5. Transfers

Data may be shared with the relevant broker to the extent required by listings and enquiries, with hosting, email and translation infrastructure providers, with analytics and advertising-measurement providers where you have consented (e.g. Google, Meta), and with competent authorities where legally required. We maintain data processing agreements with these providers; where data is transferred abroad (e.g. to servers outside the European Economic Area), appropriate safeguards such as the providers' standard contractual clauses (SCCs) are relied upon.

6. Retention

Personal data is retained for the duration of membership and the limitation periods set out in applicable legislation, after which it is deleted, destroyed or anonymised.

7. Your Rights

Under Art. 11 KVKK you may: learn whether your data is processed; request information; learn the purpose of processing; know the third parties it is transferred to; request correction of incomplete or inaccurate data; request deletion or destruction; object to results produced exclusively by automated systems; and claim compensation for damages. If you believe your request has not been adequately addressed, you may also lodge a complaint with the competent data protection authority.

8. How to Apply

You may submit requests regarding your rights to info@openyachtbid.com or info@openyachtrental.com by email or in writing to the Company address. Applications are concluded free of charge within 30 days at the latest. You may also request account deletion, or a copy of your data, from your account page.

9. Visitors from the European Economic Area (GDPR)

If you access the platform from the European Economic Area (EEA) or the United Kingdom, your personal data is additionally processed in accordance with the EU General Data Protection Regulation (GDPR). The Company acts as "data controller" for this processing; the providers we engage act as "data processors". The legal basis for processing is, depending on the purpose: performance of a contract (Art. 6(1)(b) GDPR), compliance with a legal obligation (Art. 6(1)(c)), legitimate interest (Art. 6(1)(f)), or explicit consent (Art. 6(1)(a), e.g. cookie consent).
